The purpose of this document is to establish the General Conditions of Use and the General Conditions of Sale and Returns of the online sales website www.mayamallorca.com and all its sub-domains.

Identity of the parties:

The general conditions of sale described below (hereinafter General Conditions of Sale), exclusively govern the contractual relations between any user of the Web page www.mayamallorca.com (hereinafter referred to as “User”) and the seller, who is Carolina Estarellas Leclerc, with N.I.F.: 43067932H and domiciled in Gran Via Penyes Rotges, nº48A-apto.101 07180 Santa Ponsa Placing your order:

• You must be of legal age to make a purchase at www.mayamallorca.com
• When registering, you must provide us with: a mobile or landline telephone number, an e-mail address, a first and last name, the complete delivery address (including postal code, town and province), and the name of the company
• The means of contact that we will use to send you the notifications about your order will be mainly by e-mail, although sometimes we can also use the telephone or the physical postal address.
• The conditions of use and purchase of this website are ONLY valid for purchases made in Spain, within the Iberian Peninsula.
• If we accept your order, you will receive in your email previously provided in your user account, our acceptance by issuing an Order Confirmation. This Order Confirmation will be effective from the moment it is sent. If we cannot accept your Order, we will try to contact you by email, phone or mail.

Prices:

• Once the purchase is completed and as quickly as possible, within reason, and within 24 hours, Carolina Estarellas Leclerc, will send customers an email with the receipt of the order containing the summary of the purchase, as well as payment information if applicable and shipping and billing information.
• Very occasionally the prices of the products shown on our website, www.mayamallorca.com , may be erroneously specified and show a lower or higher price than the correct one. When this happens and, if we have confirmed your order, we will immediately contact the user in order to issue a new order confirmation with the correct price. In the event that the correct price is higher, you may cancel your order and we will refund any amount you have already paid.
• There may be occasions when it is impossible for us to supply the products ordered because, for example, such products are no longer manufactured or available. In such cases we will contact you to inform you and may suggest alternative products that you may wish to purchase. If you do not accept our suggestions we will cancel your order in relation to the products we are unable to supply and refund any monies paid to us for such products. The refund of these sums of money will be the limit of our liability to you if we are unable to supply the products to you.
• We reserve the right to modify our prices at any time. However, we undertake to apply the current rates indicated on the website at the time your order is placed.
• Shipping costs, where applicable, are to be borne by the user, as indicated on the order and invoice.
• V.A.T. at the applicable rate indicated on your invoice will be charged to you.
• The price of the products includes V.A.T. at the end of the corresponding purchase and will be the one indicated in your order and/or invoice.

Availability:

• The availability of the products offered by Carolina Estarellas Leclerc through its web pages may vary depending on customer demand. Although Carolina Estarellas Leclerc updates the stock periodically, the product requested by the customer could be out of stock at that moment. In such case, Carolina Estarellas Leclerc will send an e-mail to the customer informing him/her of the impossibility of fulfilling the order.

Delivery of your order:

• The schedule of reception of orders is twenty-four (24) hours the three hundred and sixty-five (365) days of the year, although orders placed after seventeen (10) hours will not be processed, remaining for the next working day in the city of Palma de Mallorca. Orders received during the weekend will be processed first thing on the following Monday, or first working day.
• The time between the placement of the order and the date of the first delivery attempt by the carrier to the address indicated in the order corresponds to the sum of these 2 factors:

1. Shipment preparation time ( 48 h) = validation and verification of your data and payment + preparation of your order + pick up by the carrier.
2. The transport and delivery time of your order will depend on the transport company.
3. Orders placed after 10:00 a.m. will be prepared the following day, not counting Saturdays, Sundays or holidays. Standard shipments will have an estimated delivery time of 5 working days also valid for Peninsula, Portugal and Balearic Islands. The estimated delivery time in Europe will be from 5 to 10 working days. Carolina Estarellas Leclerc also has a local collection system available for all Spain, however, the local is only available in C/ Nou, 2 bajos, Palma de Mallorca (Baleares). Local pick-up is free of charge.

These deadlines are indicated in working days. Payment of your order(s): All payments will be made in Euros.

1. A) Payment by credit/debit card: If you choose to pay by credit/debit card, your order cannot be taken into account and will not be processed until the payment has been authorized by your bank or cashier. Online payment by credit card is done through the “RedSys” security system, which encrypts your bank details when they are transmitted over the Internet. For security reasons, Carolina Estarellas Leclerc verifies all orders paid by credit card.

The data provided will not be used under any circumstances for any purpose other than those specifically mentioned here. In no case will be transferred to third parties and can only be used by Carolina Estarellas Leclerc and only to make the purchases you request. Our secure server guarantees the privacy of the data you transmit to us. This privacy is achieved through the SSL protocol, encrypting the data sent through the RSA encryption system, when it is located in a secure area of a browser. Your browser, collaborating with the secure server, encrypts the data so that if another person, in the transmission process, gets hold of it, he/she will not be able to read it because he/she does not have the necessary key. You can check that your browser is secure if you see the security marks, such as a key or a padlock.

1. B) Paypal: If you pay by Paypal, your order will not be reserved or shipped until we have received payment in our bank account. If we do not receive payment for the full amount within 7 days of the date of your order, your order may be cancelled.

Delivery of your order:

• The order will be shipped to the address you provided at the time of purchase. www.mayamallorca.com does not guarantee delivery to postal mailboxes.
• You may cancel your order at any time prior to shipment by sending an email to info@mayamallorca.com indicating your order number.
• Deliveries are made as quickly as possible.
• The method of payment chosen by the user may affect delivery times

Defective item:

• If the item you have received is defective, please contact +34692989122 specifying your order number, your name and address, the product details and the reason for the return, as well as whether you are requesting a refund or an exchange. We will then tell you how to proceed with the return. You have 15 days from receipt of the defective item to return it to us.
• At the time of delivery you must carefully check the condition in which the goods are delivered and the number of packages delivered as indicated on the delivery note of the carrier. In case of errors in the delivery received or if it is visibly damaged, it is important that it is reflected in the delivery note of the carrier and inform Carolina Estarellas Leclerc of these facts within 24 hours and in writing via email to info@mayamallorca.com or by any other means.

Receiving the wrong item:

• If the item you have received is not the one you originally ordered, please contact +34692989122 specifying your order number, your name and address, the product details and the reason for the return, as well as whether you are requesting a refund or an exchange. We will then tell you how to proceed with the return.
• Carolina Estarellas Leclerc will bear the cost of collection of the wrong product and delivery of the product corresponding to the order placed.

No returns will be accepted for:

In accordance with Law 3/2014, of March 27, which modifies the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.

• Products with the opening seal or packaging opened or damaged.
• Products where improper handling or cleaning is evident.
• Shipping costs, insurance and any damage that may occur during transport shall be borne by the Customer.
• The receipt of the product does not imply acceptance or conformity of the return, so Carolina Estarellas Leclerc may have a period of seven (7) days to inform the Customer of any disagreement that may arise. In addition, Carolina Estarellas Leclerc reserves the right to apply a penalty in the value of the initial refund in the event that the product does not arrive in perfect condition.

Request cancellations: Under the Distance Shipping Regulations, you have the right to cancel the order of any item purchased from Carolina Estarellas Leclerc, with a full refund. Cancellation requests must be made in writing to info@mayamallorca.com, specifying your order number, within 7 to 14 business days of receipt of the items. To cancel your standard shipping order send an email to info@mayamallorca.com. To cancel your next day shipping order call us at +34692989122. Return or exchange an item:

• If you are not completely satisfied with your purchase, simply return the item(s) to us in its original condition within 14 days of receipt. We will send you a refund receipt, or exchange the item(s) for another one if you prefer. However, shipping charges are only refunded if you have cancelled the entire order within 7 days or if the items are defective and a refund has been issued.
• The reimbursement of the amounts paid will be made through the payment method used for the purchase.

Please note:

• The item is the responsibility of the user until it reaches us. For your own protection, we recommend that you send the package through a shipping service that will insure you for the value of the items.
• The cost of returning the item is the responsibility of the customer.
• The package may take up to 7 working days to arrive at our warehouse, unless it is sent by special courier.

• Our warranties are governed by the provisions of the R.D.L. LAW 23/2003, of July 10, 2003, of Guarantees in the Sale of Consumer Goods.
• All NEW products that you can buy at www.mayamallorca.com have a maximum warranty specific to each product as they are consumables.

Content and information provided on our website:

• Carolina Estarellas Leclerc reserves the right to modify the commercial offer presented on the www.mayamallorca.com website.
• (modification on products, prices, promotions and other commercial and service conditions) at any time.
• Carolina Estarellas Leclerc puts all reasonable means at its disposal to try that the information shown in its Internet page is truthful and without typographical errors. If any error of this type, beyond the control of Carolina Estarellas Leclerc, should occur, it will be corrected immediately, as soon as it is detected. If the error occurs in some of the prices shown and a customer had made a purchase, we will communicate this error and the customer or user will have the right to cancel the order without cost on his part. The sending of an automatic confirmation of purchase, does not validate the conditions of an erroneous price.
